PvP and Homekilling are two separate things, one is allowed (PvP), while one is not (Homekilling). If someone is clearly inside their house, or anything they own (There should be a sign on the door, wall or conspicuous place), then they are allowed to stay there.
I realise this is a cowardly move by some, but unfortunately, rules are there for the enjoyment of ALL, not for the pleasure of a few. If they want a quick healing break, let that be that.
PS: If they kill you whilst you are in their home, it's allowed.
